Open Swim Waiver

PRIVATE OPEN SWIM ACKNOWLEDGMENT

I understand that Swim2Live Private Open Swim is a private pool rental and recreational swimming activity and is not a supervised swimming lesson or lifeguarded activity. Swim2Live instructors and staff may not be present during the reservation.

I understand that swimming and activities in and around a swimming pool involve inherent risks, including but not limited to slips, trips, falls, collisions, injuries, drowning, or other serious injury. I voluntarily assume these risks for myself and for any minor child(ren) for whom I am legally authorized to sign.

ADULT SUPERVISION

I understand that a responsible adult must actively supervise all children at all times while they are in or around the pool and anywhere on the Swim2Live property. Children may never be left unattended.

I understand that I am responsible for determining the swimming ability of the children and guests in my group and for providing appropriate flotation devices or U.S. Coast Guard-approved life jackets when needed.

GUEST RESPONSIBILITY

I understand that my reservation may include family members or invited guests. I accept responsibility for ensuring that everyone in my group follows all Swim2Live pool and property rules.

I agree that no diving, running, rough play, unsafe behavior, or use of the pool while impaired by alcohol, drugs, or any substance that affects judgment or coordination is permitted.

PROPERTY, SLIPS, FALLS & ASSUMPTION OF RISK

I understand and acknowledge that swimming pools, decks, patios, walkways, steps, grass areas, driveways, and other areas of the property may present inherent risks. These risks may include wet or slippery surfaces, uneven surfaces, slips, trips, falls, collisions, and other accidents or injuries.

I voluntarily assume these risks for myself and any minor(s) for whom I am legally authorized to sign. I understand that I am responsible for exercising reasonable care while on the property and for actively supervising the children and guests in my care.

To the fullest extent permitted by law, I agree to release and hold harmless Swim2Live, its owners, employees, instructors, representatives, and property owners from claims arising from ordinary risks, accidents, slips, trips, falls, or injuries occurring in or around the swimming pool or elsewhere on the property during my Private Open Swim reservation, except for claims that cannot legally be waived or released.

ASSUMPTION OF RISK & RELEASE OF LIABILITY

By signing this Agreement, I acknowledge that I understand the risks associated with swimming, recreational pool activities, and being on the Swim2Live property, and I voluntarily assume those risks.

To the fullest extent permitted by law, I agree to release and hold harmless Swim2Live, its owners, employees, instructors, representatives, and property owners from claims arising from the ordinary and inherent risks associated with participation in Private Open Swim and use of the property, except to the extent a claim cannot legally be waived or released.

I understand that this Agreement does not waive any rights or claims that cannot legally be waived under applicable law.

PROPERTY & POOL RULES

I agree to:

• Provide active adult supervision of all children at all times.
• Keep children who cannot swim independently within immediate reach of a responsible adult.
• Follow all posted pool and property rules.
• Refrain from running, diving, rough play, or other unsafe activities.
• Use appropriate flotation devices or life jackets for swimmers who need them.
• Keep glass containers out of the pool and pool area.
• Respect the property, pool equipment, furnishings, landscaping, and surrounding areas.
• Leave the pool and surrounding area in the condition in which it was found.
• Immediately stop swimming and exit the pool area if weather or other conditions become unsafe.

EMERGENCY RESPONSIBILITY

I understand that because Private Open Swim is an unsupervised recreational activity, I am responsible for responding to an emergency involving myself, my children, or my guests and for contacting 911 when necessary.
